Terms and Conditions applying to all bookings for Eastbourne Holiday Cottages - please read before booking.

(1) CONTRACT

1(a) By making a booking for one of our properties, you agree that these Booking Terms apply to that property booking. Eastbourne Holiday Cottages acts as an agent on behalf of the property owner and once the booking is confirmed the contract is between you and the owner.

Please note when you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent to you by post or email.

The Occupier is the person responsible for the booking and is responsible for the conditions of hire. The occupier must notify the agent of any changes to the number of people or pets staying at the property in writing before the booking starts.

1(b) This contract will be governed by the laws of England.

(2) RESERVATIONS & CANCELLATIONS

2(a) If you make your reservation four or more weeks before the rental period begins: You must pay a reservation fee of one hundred pounds per week booked, within 24 hours of making your provisional booking. Payments can be made by debit or credit card or direct bank transfer at the time you make the booking; A charge of 2.5% is added to all card payments to contribute to the additional banking charges incurred by EHC.

2(b)You must then pay the balance of the Rental Price plus a £200 good housekeeping deposit no later than four weeks before the rental period begins. Any shortfalls in payment due to exchange rates or bank charges must be paid by the occupier prior to arrival. If we do not receive the balance of the Rental Price by that time, we will assume you have cancelled your booking and you will forfeit your reservation fee.

2(c) If you reserve the property less than four weeks before the date you are due to arrive, you must pay the Rental Price plus the good housekeeping deposit in full when you make the booking.

2(d) After the full payment is received you will be sent confirmation, and directions/access details by e-mail. Please read these carefully and contact EHC immediately if anything is incorrect.

2(e) Cancellation by you of your booking must be in writing (e-mail or letter). Cancellation charges are as follows: Number of days before holiday start date that notification is received:
More than 28 days - cancellation charge - Deposit £100 per week booked,
Less than 28 days - cancellation charge - 100% of rental
If you cancel at any time we will endeavour to re-let the property. If a replacement is obtained, we will refund all monies paid by you for the rental, less our administration fee of £50. We would recommend you take out an insurance cancellation policy.
The owner has the right to refuse or cancel any bookings subject to refunding any sums already paid.

(3) LOOKING AFTER THE PROPERTY

3(a) Guests are legally bound to notify Eastbourne Holiday Cottages of any breakages or damage to the property. In the event of major damage to items of furniture, furnishings and bed linen the cost of repair, replacement or additional cleaning will be taken from the good housekeeping/security deposit.

3(b) You must take all reasonable care of the Property and leave its furniture, fittings and effects in the same clean and tidy condition at the end of the rental period as at the beginning.

3(c) Smoking is not permitted in any of Eastbourne Holiday properties.

3(d) The occupier must adhere to the arrival and departure times provided by the agent on their booking information.

3(e) Stag or hen party groups and unaccompanied teenagers are not permitted at any of the properties.

3(f) The owner reserves the right to terminate the occupiers stay if:

- there is unreasonable behaviour
- they cause a nuisance to other parties or damage to the property
- if the number of guests exceed the stated occupancy or
the property is used for any illegal or commercial activities

3(g) The good housekeeping deposit will be returned to the guest one week after the end of their stay provided that the property has been left in a satisfactory condition. The deposit is held to cover any damages, losses or additional cleaning charges that may arise as a result of the property being left in an unsatisfactory condition, but excluding reasonable wear and tear.

3(h) Any personal items left in the property will be held for two weeks and if unclaimed after this time will be donated to a local charity shop. A minimum fee of £10 will be required prior to posting any items back to the owners.

3(i) In the event of a guest locking themselves out of a property a £25 call out charge will be made to access the property. If EHC is unable to access the property with their spare key, and other professionals need to be called the guest will be responsible for any replacement and repair charges incurred.

This booking is granted by the owner to the occupier for the holiday period and is not intended to create the relationship of landlord and tenant between the parties. The occupier is granted the right to occupy the property for the holiday period specified but the occupier has no right to remain in the accommodation after this time and shall not be entitled to any statutory security of tenure.
- In any of the circumstances in this clause no refunds will be made and you will have no further claim against the owner or the agent.

(4) WHAT IS INCLUDED

All utilities are provided and included in the rent. In properties with fires and stoves fuel is not provided. All bed linen and towels are provided for the number of beds in each property. We ask that guests bring their own beach towels and tea towels.High chairs and travel cots are available to hire but guests should bring their own baby bedding.

(5) CHILDREN

Guests must accept responsibility for the safety of their children at all times whilst staying with Eastbourne Holiday Cottages. Children must accompanied by an adult guest at all times.

(6) Pets

We only accept pets in those properties identified as "Pet Friendly".
A charge will be levied per pet per week.
The occupier will be responsible for
- ensuring no pet is left unattended in the property or garden
- ensuring that pets are clean and dry before entering the property
- not allowing pets on furniture or into bedrooms
- clearing and disposing of all pet fouling before departure.
Please note we cannot guarantee that "non" pet friendly properties have never had pets in them before.

(7a) LIABILITY

Eastbourne Holiday Cottages, its employees and agents do not accept third party liability in respect of breach of contract, negligence, misrepresentation. Neither the agent or the owner will be liable to the occupier or members of his party for any accident, loss, damage, injury, expenses or inconvenience that may be incurred in connection with the rental howsoever suffered or incurred by the occupier. The owner or agent will not be responsible for cancellation due to unusual and unforeseeable circumstances beyond their control ie. fire, flood. We recommend you insure for such loss.

(7b) PAYMENT SECURITY

When making payment to Eastbourne Holiday Cottages via bank or BACS transfers please ensure that you check the full details below. Eastbourne Holiday Cottages will not be held responsible for payments made to any other accounts.

(8) COMPLAINTS

If you feel you have a reason to complain about the property, you must tell us immediately so the agent/owner can do their best to resolve the issue. It is impossible for us to fully investigate complaints and take remedial action after departure. The agent/owner must be given the opportunity to remedy any issues that occur at the time.

(9) ACCESS

You must give us or our representative access to the property at any reasonable time while you are renting it to carry out essential maintenance or if there is an emergency.

(10) DESCRIPTIONS

Whilst every effort is made to ensure the accuracy of the property details on the website, all descriptions are made in good faith and are for guidance only.

(11) DATA PROTECTION

By making a booking, you agree that we may store and use your information as required to complete your booking and allow you to stay at the cottage. We may from time to time use this information, solely for the marketing of our services. If you do not wish us to do so please advise us accordingly.

INTERNET ACCESS TERMS & CONDITIONS

This agreement sets out the terms and conditions on which internet access (“the Service”) is provided free of charge to you, a guest of Eastbourne Holiday Cottages (“us”) in consideration for your custom. Please read these in full before using the provided password. Logging on to the Service infers your agreement to these terms and conditions.

1. EXTENT OF THE SERVICE

1.1. We do not recommend in particular the use of any websites (or other internet related services) (“Internet Services”) and your use of Internet Services is carried out entirely at your own risk.
1.2. We have no responsibility for, or control over, the Internet Services you access and do not guarantee that any services are error or virus free.
1.3. We have no responsibility for, or control over, the information you transmit or receive via the Service.
1.4. Save for the purposes of network diagnostics we do not examine the use to which you put the Service or the nature of the information you send or receive.
1.6. Whilst we take reasonable steps to ensure the security of the Service and to prevent unlawful access to information transmitted or received using the Service we do not guarantee the security of the information which you may transmit or receive using the Service or located on any equipment utilising the Service and you accept that it is your responsibility to protect your information and have adequate security (in terms of equipment and procedures) to ensure the security, integrity and confidentiality of your information and data.
1.7. We reserve the right at all times to withdraw the Service, change the specifications or manner of use of the Service, to change access codes, usernames, passwords or other security information necessary to access the service.
1.8 We will attempt to help resolve technical questions to the best of our ability, but are unable to make any guarantee on the reliability of WIFI connection during guest stays.

2. YOUR USE OF THE SERVICE

2.1. You must not use the Service to access Internet Services, or send or receive e-mails, which:
2.1.1. are defamatory, threatening, intimidatory or which could be classed as harassment;
2.1.2. contain obscene, profane or abusive language or material;
2.1.3. contain pornographic material (that is text, pictures, films, video clips of a sexually explicit or arousing nature);
2.1.4. contain offensive or derogatory images regarding sex, race, religion, colour, origin, age, physical or mental disability, medical condition or sexual orientation;
2.1.5. contain material which infringe third party’s rights (including intellectual property rights);
2.1.6. in our reasonable opinion may adversely affect the manner in which we carry out our business; or
2.1.7. are otherwise unlawful or inappropriate;

2.2. Music, video, pictures, text and other content on the internet are copyright works and you should not download, alter, e-mail or otherwise use such content unless certain that the owner of such works has authorised its use by you.
2.3. We may terminate or temporarily suspend the Service if we reasonably believe that you are in breach of any provisions of this agreement including but not limited to clauses 2.1 to 2.3 above.
2.4. We recommend that you do not use the service to transmit or receive any confidential information or data and should you choose to do so you do so at your own risk.
2.5. The Service is intended for consumer use only. In the event that you use the Service for commercial purposes we would specifically refer you to clause 4.2 below.

3. CRIMINAL ACTIVITY

3.1. You must not use the Service to engage in any activity which constitutes or is capable of constituting a criminal offence, either in the United Kingdom or in any state throughout the world.
3.2. You agree and acknowledge that we may be required to provide assistance and information to law enforcement, governmental agencies and other authorities.
3.3. You agree and acknowledge that we may keep a log of the Internet Protocol (“IP”) addresses of any devices which access the Service, the times when they have accessed the Service and the activity associated with that IP address
3.4. You further agree we are entitled to co-operate with law enforcement authorities and rights-holders in the investigation of any suspected or alleged illegal activity by you which may include, but is not limited to, disclosure of such information as we have (whether pursuant to clause 3.3 or otherwise), and are entitled to provide by law, to law enforcement authorities or rights-holders.

4. OTHER TERMS

4.1. You agree to compensate us fully for any claims or legal action made or threatened against us by someone else because you have used the service in breach of these terms and conditions, and in particular clause 2.1 to 2.3 and 3.1 above.
4.2. Whilst we do not seek to limit our responsibility for fraudulent misrepresentation or if you are injured or die as a result of our negligence, we have no responsibility (to the extent permitted by law) to compensate you (whether or not we are negligent) for any direct financial loss, loss of profit, revenue, time, anticipated savings or profit or revenue, opportunity, data, use, business, wasted expenditure, business interruption, loss arising from disclosure of confidential information, loss arising from or in connection with use of the service or inability to use or access the service or a failure, suspension or withdrawal of all or part of the service at any time or damage to physical property or for any other similar direct loss that may arise in relation to this agreement whether or not we were advised in advance of the possibility of such loss or damage.
4.3. We agree that neither this agreement does not allow either party to act as, or hold themselves out as, acting as an agent of the other party and that the terms of this agreement are not enforceable by a third party under the Contracts (Rights of Third Parties) Act 1999.
4.4. This agreement is governed by the law of England and Wales and is subject to the non-exclusive jurisdiction of the English courts.
